一、依據教育部 102 年 10 月 24 日臺教人(二)字第 1020153138 號函轉臺北市政府衛生局 102 年 10 月 7 日北市衛醫護字第 10238219301 號函辦理。
二、依教育部 101 年 12 月 24 日臺人(一)字第 1010213931 號函規定：「……符合下列情形者，得辦理執業登記：「(一)公立高級中等以下學校輔導教師（含主任輔導教師、輔導主任、輔導組長及兼辦輔導工作之教師）從事學生諮商輔導工作，得以服務學校為辦理執業登記之處所；惟如學校未符心理諮商所設置標準，則得以縣市政府諮商輔導中心為辦理執業登記之處所。(二)另公立大學校院教師於服務學校諮商輔導中心從事諮商工作，或因執行帶領學生實習（非僅開設課程而未執行實習者）所需，得以服務學校諮商輔導中心為辦理執業登記之處所(三)另為利專業資源共享，前開教師如事先書面報經服務學校同意，並得依心理師法第 10 條規定……得至其他學校、機關(構)(如：育幼院、法院等)或直轄市、縣(市)層級學生輔導諮商中心支援諮商業務。」。

三、次查心理師法第 7 條 1 項規定：「心理師應向執業所在地直轄市、縣 (市) 主管機關申請執業登記，領有執業執照，始得執業。」同法第 10 條規定：「心理師執業以一處為限，並應在所在地直轄市、縣 (市) 主管機關核准登記之醫療機構、心理治療所、心理諮商所或其他經主管機關認可之機構為之。但機構間之支援或經事先報准者，不在此限。」及第 11 條第 1 項規定：「心理師歇業或停業時，應自事實發生之日起 30 日內，報請原發執業執照機關備查。」。
四、另查醫事人員執業登記及繼續教育辦法第 7 條規定：「醫事人員辦理執業執照更新，應於其執業執照有效期間屆滿前 6 個月內，填具申請書並檢具下列文件及繳納執業執照費，向原發執業執照機關申請換領執業執照：一、原領執業執照。二、最近 3 個月內之 1 吋正面脫帽半身照片 2 張。三、執業所在地醫事人員公會會員證明文件。四、繼續教育或其他相關證明文件：（一）專科醫師：完成第 13 條第 1 項第 2 款至第 4 款所定繼續教育之證明文件。（二）專科護理師：中央主管機關發給，且仍在有效期間內之專科護理師證書。（三）前 2 目以外之醫事人員：完成第 13 條第 1 項各款所定繼續教育之證明文件。」。
五、邇來臺北市發生多位公立大學院校教師具有本國諮商心理師或臨床心理師資格，執業登錄後在校內並未從事心理師業務者，惟依法須至臺北市政府衛生局辦理執業異動(更新執業執照、歇業、停業、復業)手續，或另有從事上開業務但未辦理執業登記者；為保障教師之權益，爰請具有心理師資格之教師切勿違反法規，以免受罰。
